Loan officer and borrower discussing loan processing in Alabama

Is Alabama a Title State or an Attorney State?

Alabama is a title state. Title companies, attorneys and banks all conduct closings, and attorney involvement in the closing itself is not legally required: the Alabama Supreme Court allows a title company to conduct a closing as long as it gives no legal advice.

Is Alabama a Community Property State for Mortgages?

No. Alabama is not a community property state, and dower and curtesy have been abolished. Alabama's homestead law says a married person's mortgage on the homestead isn't valid without the other spouse's voluntary signature and assent, shown by that spouse's acknowledgment before a notary or other authorized officer.
