Is Mississippi a Title State or an Attorney State?

Mississippi is an attorney state by custom. Attorneys customarily conduct closings, and Mississippi law treats certifying title to someone else's real estate as the practice of law, so title insurance companies certify title through an agent licensed to practice law in Mississippi.

Is Mississippi a Community Property State for Mortgages?

No. Mississippi is not a community property state, but Mississippi law says a deed of trust on a homestead isn't valid unless the owner's spouse signs it, when the owner is married and living with that spouse, even if the spouse isn't on title. The Mississippi Supreme Court has long held that a deed of trust securing the purchase money for a homestead is valid without the spouse's signature, so the rule mainly comes up on refinances and home equity loans.
