Loan officer and borrower discussing loan processing in Kentucky

Is Kentucky a Title State or an Attorney State?

Kentucky uses both. Attorneys and title companies handle closings, and attorney involvement in the closing itself is not legally required: the Kentucky Supreme Court has held that a non-attorney may conduct a real estate closing as long as they don't answer legal questions or give legal advice. Title examinations, however, are the practice of law in Kentucky.

Is Kentucky a Community Property State for Mortgages?

No. Kentucky is not a community property state, but it still recognizes dower and curtesy: a surviving spouse can keep an interest in real estate the other spouse owned during the marriage unless that right was released. A mortgage doesn't cut off a spouse's dower or curtesy unless that spouse joins in it or releases the right separately.
