Loan officer and borrower discussing loan processing in Utah

Is Utah a Title State or an Attorney State?

Utah is a title state. Title and escrow companies handle the closing, and attorney involvement is not legally required. The Utah Supreme Court's practice-of-law rule expressly lets title companies issue title reports and prepare deeds for customers.

Is Utah a Community Property State for Mortgages?

No. Utah is not a community property state, and Utah law has abolished dower and curtesy.

When Can Closing Funds Be Disbursed in Utah?

Utah law bars a title company from paying out escrow money until the deposit is “collected and cleared.” Cash and wire transfers can be disbursed the same day they're deposited, while other deposits, including most checks, have to clear first.
