Loan officer and borrower discussing loan processing in Nebraska

Is Nebraska a Title State or an Attorney State?

Nebraska is a title state. Title and escrow companies typically handle the closing, and Nebraska Supreme Court rules let title companies prepare closing documents such as deeds and closing statements, so attorney involvement is not legally required.

Is Nebraska a Community Property State for Mortgages?

No. Nebraska is not a community property state, and it abolished dower and curtesy in 1907. Nebraska law says a married person's homestead can't be mortgaged unless both spouses sign and acknowledge the instrument, and the Nebraska Supreme Court treats a homestead mortgage without both as void. A mortgage or deed of trust given at purchase to buy the home is the exception.

Does Nebraska Have a Good Funds Law for Closings?

Yes. A Nebraska closing agent must have received good funds, such as wired funds or cashier's checks, that are available for disbursement at closing, apart from a small amount the law allows. The agent must also pay out closing funds only from a trust account at a federally insured institution, and a lender closing its own loan is outside the rule.
