Is Louisiana a Title State or an Attorney State?

Louisiana works differently from other states. Under its civil-law system, the closing is customarily handled by a notary public, who is generally also an attorney, and the sale and mortgage are signed before that notary. Louisiana law also requires every title insurance policy on real estate to be based on a title opinion from a Louisiana-licensed attorney.

Is Louisiana a Community Property State for Mortgages?

Yes. Louisiana is a community property state; its default marital regime is the community of acquets and gains. Both spouses must concur to mortgage community real estate, and property a spouse holds during the marriage is presumed to be community unless shown to be separate.

How Is a Louisiana Mortgage Signed?

A Louisiana mortgage is typically signed as an authentic act: before a notary public and two witnesses, with the notary paraphing (initialing) the note to tie it to the mortgage.
