Loan officer and borrower discussing loan processing in Washington

Is Washington a Title State or an Attorney State?

Washington is a title and escrow state. Closings are typically handled by escrow companies or the escrow departments of title companies, and a Washington Supreme Court rule allows certified non-attorneys to prepare the closing documents, so an attorney isn't needed for a typical closing.

Is Washington a Community Property State for Mortgages?

Yes. Washington is one of nine community property states, and both spouses generally must sign the deed of trust to borrow against community real estate. State registered domestic partners are treated the same as spouses.

Does a Spouse Who Isn't on Title Need to Sign in Washington?

Yes, on the home the couple lives in. Washington's homestead law requires both spouses or domestic partners to sign a deed of trust on the family home, even when the home is one spouse's separate property and only that spouse is on title. The homestead applies automatically once the owner lives in the home as a principal residence.
